Terms of use

Preliminary Article: Definitions

Subscription: contract signed by a Subscriber allowing him or her to have access to the services offered by Sanctuary at preferential rates in return for the payment of a monthly sum indicated in the special conditions.

Member/Subscriber: any individual or legal entity that has purchased a Subscription or bought Credits or a pack of Credits sold by Sanctuary. The Member accepts all of the General Terms and Conditions of Sale on the date of purchase.

Block: a succession of one or more sessions in a row.

General Conditions of Sale: these provisions, governing the contractual relations between Sanctuary and the Members.

Credits: means the credits awarded to Members following the purchase of Credits, a Package or a Subscription, allowing them to access Sessions.

Pack: Credits are offered in batches, referred to as a Pack. The list of Packs is available on the websites.

Sanctuary: a brand belonging to THE SANCTUARY GROUP, a simplified joint-stock company with a share capital of €139,733, located at 33, Boulevard Saint Martin in PARIS (75010), registered with the Paris Trade and Companies Register under number 793 052 499, represented by its President.

Session: a sports session offered by Sanctuary and led by a coach.

Studio: a space dedicated to sporting activity and operated by The Sanctuary Group.

Title: refers to either Credits, Packs, or Subscriptions.

Article 1: object

The General Terms and Conditions of Sale constitute the sole and exclusive framework for the legal relations to exist between the Member and Sanctuary, to the exclusion of any other document or advertising brochure.

The General Conditions of Sale are applicable to all Members.

Article 2 – Registration terms and conditions of access

Anyone wishing to participate in a Session must first:

(i) Acquiring a Title:

– Either buy a Credit Pack; ;

– Either subscribe to a Subscription.

Once in possession of Credits, a Subscription, or a Pack, the member shall be considered a Member of Sanctuary for the entire duration of validity of the Purchased Title. The purchase of Credits, Packs, or Subscriptions shall ipso facto result in the Member’s acceptance of all the provisions set out in the General Terms and Conditions of Sale.

(ii) Proceed with its registration for a Session

The Member, holding valid Credits, Packs or Subscriptions, must, in order to participate in a Session held at the Studios, register in advance online on the websites, or via the Sanctuary mobile application or directly on-site with a member of Sanctuary staff.

The room cannot accommodate more people than the number indicated in Article 17.2 «Maximum Attendance,» so it will no longer be possible to register for Sessions once the maximum number of people has been reached. The Member must make payment for their Credits, Packages, or Subscriptions before they can register.

The Member is responsible for their bookings; it is their responsibility to verify the accuracy of each of their bookings (location, date, time, number of places) at risk of having any booked and unused Sessions deducted.

Any amendments must be made as soon as possible and no later than 12 hours before the start of the Session.

Article 3 – General Conditions of Sale applicable

The General Terms and Conditions of Sale may be subject to updates or modifications without prior notice. The applicable General Terms and Conditions of Sale are those in effect at the time the contract is concluded, i.e., on the day the Member acquires Credits, Packs, or a Subscription. However, the applicable Internal Regulations are those in effect on the day the Member visits the Studio. By registering for Sessions, the Member agrees to abide by the Internal Regulations in effect on the day the class is provided, and in particular, the start and end times of the Session.

Article 4 – Services, duration, postponement, termination

4.1 Conditions

Credits, the subscription or pack purchased grant a right of access to the sessions offered by the Studio. This right is non-transferable.

Purchases of these services in-store cannot be refunded, and online purchases of these services may be subject to a right of withdrawal as provided for by the Hamon law.

Any cancellation or amendment to a Session must be made at least 12 hours before the start of the booked Session. Otherwise, the Member will have the booked Session deducted from their account or will be subject to financial penalties, notwithstanding their absence. The financial penalties for late cancellation (less than 12 hours before the start of the Session) and for absence from a booked and uncancelled Session are five (5) euros.

The price is shown on the special conditions of the contract provided to the client and on the Sanctuary brands' websites.

The Member declares, in all circumstances at the conclusion of the Subscription contract, that they have had their fitness to practise sports activity checked beforehand by a doctor and possess the certificate to this effect issued by the doctor, so that they can produce it upon request by Sanctuary. The Member also undertakes to take all necessary precautions for their health, safety and hygiene and to comply with Sanctuary's instructions in this regard.

The Member may not assign or transfer the Subscription taken out under the Agreement to anyone in any way, whether gratuitously or for consideration.

4.2 Duration and deferment

  1. 2.1 Validity of Packs and Subscriptions
  • From the billing date, 16 Credit Packs are valid for one month, 60 Credit Packs are valid for 2 months, 120 Credit Packs are valid for 4 months, 240 Credit Packs are valid for 8 months, and 480 Credit Packs are valid for 16 months.
  • Regarding the 14 Credit, 26 Credit and 39 Credit Subscriptions, the Credits are valid for 1 month from the billing date. Credits are credited to the Subscriber's account every week.

It is understood that any promotion or new offer will have a specific duration, as specified in the particular conditions.

  1. 2. 2 Report

The non-use of Sessions during the validity period of the entitlement will not result in a refund of unused Sessions by the Member. However, the validity period of Credits within the framework of Subscriptions may be extended in the event of studio closures, excluding summer holidays and the Christmas period.

Subscriptions and Packages can have their validity extended if the Member provides proof of physical unsuitability for sports practice for more than 1 (one) month. A written request must be made, accompanied by a medical certificate of unsuitability for sports practice, specifying the duration of the incapacity to engage in this activity. The request must be made before the expiry of the Subscription and Credits. Otherwise, the request will be deemed inadmissible.

  1. 3 Non-payment of sums due by the Member for the Subscription

In the event of non-payment of sums due by the Member to Sanctuary, Sanctuary reserves the right to suspend access to the Studios and services provided under the Membership and to list the Member on its disputed payment recovery file, in strict compliance with the provisions of law n° 78-17 of 6 January 1978 relating to data protection, such listing preventing the Member from benefiting from advantages, products and/or services that Sanctuary, its affiliated companies or its partners may have reserved for them.

In the event of delayed payment of sums due, Sanctuary reserves the right to terminate the Subscription and to demand settlement within 10 working days from the date of formal notice sent by post or email. From the date of termination taking effect, the Member shall be liable for payment of the contractually due sums until the end of the Subscription term. The Member will also be liable, in this case, for payment of a penalty amounting to 8 % of the sums remaining due.

  1. 4. Commitment Period for Subscriptions

There are 3 subscription packages and three commitment periods are possible. In total, 9 subscriptions are therefore offered. 

12-Month Subscription Commitments:

  • Subscription 14 Credits at 19 euros per week
  • 26 Credits Subscription for 35 euros per week
  • Subscription 39 Credits at 45 euros per week
 

Subscriptions with a 6-month commitment:

  • Subscription 14 Credits at 25 euros per week
  • Subscription 26 Credits for 39 euros per week
  • Subscription 39 Credits at 49 euros per week
 

3-month subscription plans:

  • Subscription 14 Credits at 28 euros per week
  • Subscription 26 credits at 44 euros per week
  • Subscription 39 Credits at 55 euros per week
 

Beyond the commitment period, all previously mentioned Subscriptions are tacitly renewed for an indefinite period in successive one-month periods. All Subscriptions described above are charged weekly, automatically renewed every 7 days.

  1. 5. Conditions for Termination of the Subscription by the Member
  1. 5. 1. Termination at the end of the commitment period

The Member may terminate their Subscription without cause or compensation only if the Subscriber is no longer subject to their commitment period. They must then submit a request to customer service at one of the following addresses: contact@aqua-by.com ; contact@lecercle-boxing.com ; contact@poses-studio.com ; contact@decibel-danse.com ; contact@drip-hiit.com ; contact@premierbain.com and observe a notice period of 15 working days preceding the next invoice.

  1. 5.2 Termination during the commitment period

For 12-month commitment subscriptions: should the Subscriber wish to cancel their Subscription during the commitment period, it is understood that the following conditions must be met:

  • If the termination request takes effect between the 1st (first) and the 5th (fifth) month inclusive, the Subscriber shall pay the amounts due for the Subscription during the 12 (twelve) month commitment period.
  • In case of termination taking effect between the 6th (sixth) and 9th (ninth) month inclusive, the remaining sums to be paid will be subject to a flat reduction of 15% (fifteen percent).
  • In the event of termination taking effect between the 10th (tenth) and 12th (twelfth) month, the remaining sums payable will be subject to a flat-rate reduction of 30% (thirty per cent).
 

In the case of subscriptions with a 6-month commitment: if the Subscriber wishes to terminate their Subscription during the commitment period, it is understood that the following conditions must be met:

  • In the event of termination taking effect between the 1st and 6th month, the Subscriber shall pay the sums due for the subscription over the 6-month commitment period. No flat-rate reduction will be applied.
 

In the case of Subscriptions with a 3-month commitment: if the Subscriber wishes to cancel their Subscription during the Commitment period, it is understood that the following conditions must be met:

  • If the termination takes effect between the 1st (first) and the 3rd (third) month, the Subscriber shall pay the amounts due for the Subscription over the 3 (three) month commitment period. No flat-rate reduction will be applied.
 
  1. 5.3 Exceptions

The Member may terminate their Subscription contract at any time without compensation in the following cases only:

  • Serious diseases A medical certificate must state the Subscriber's state of health and their inability to undertake any sporting activity for a defined period. The certificate must specify the nature of the illness, as well as the date on which it was first diagnosed.
  • Serious accidents A medical certificate must provide full details of the subscriber's state of health and specify the impossibility of engaging in any sporting activity for a defined period. The medical certificate must specify the nature of the accident, as well as the date it occurred.
  • Death The Subscriber's beneficiaries will need to provide the original death certificate.
  • Economic dismissal The Subscriber must provide a certified copy of the redundancy letter from their employer and a copy of their registration with Pôle Emploi.
  • Mutation/relocation Beyond a 25km radius of a Studio Sanctuary: proof of professional relocation issued by the employer or proof of new residency must be provided.
  • Pregnancy A copy of the prenatal examination sheet and the medical certificate of total contraindication indicating the duration will need to be provided. It is specified that the Subscription may be suspended due to the cases mentioned above. It will also be possible for the Subscriber to suspend their Subscription for the duration of the interruption mentioned on their medical certificates. This will extend the remaining commitment period accordingly.
 

The following cases cannot result in the termination of the Subscription contract:

  • The consequences of accidents, illnesses, or congenital conditions diagnosed prior to your enrolment or re-enrolment with Sanctuary.
  • The need to carry out a cure, an aesthetic, psychological or psychotherapeutic treatment.
  • The holidays.
 
  1. 6. Conditions for Suspending the Subscription by the Member

Sanctuary defines «suspension» as the temporary cessation of the rights and obligations binding Sanctuary to the Member and vice versa within the framework of a Subscription Contract between the two Parties. Any suspension must be time-limited at the time of its justification and have a minimum duration of 1 month. Access to the studios will no longer be permitted during these suspensions.

The Member may suspend their Subscription in the following cases:

  • In the case of a subscription with a commitment period of 3, 6, or 12 months: the subscriber may only suspend their subscription at the end of the commitment period, and this is limited to two annual suspensions of a maximum duration of 2 months per suspension.
  • In the case of a medical certificate being presented for a period exceeding 1 month. When this suspension occurs during the commitment period, the Subscriber will have their commitment period extended in accordance with the period described by the said certificate.

The following cases do not permit the suspension of the Subscription Contract:

  • A medical certificate less than 1 month old.
  • The need to carry out a cure, an aesthetic, psychological or psychotherapeutic treatment.
  • The holidays.
 

Article 5 – Prices and regulations

The current rates are displayed on the Sanctuary website, on the Sanctuary mobile app, and are available in-studio via a QR code. Sanctuary reserves the right to change its rates. The rates applicable to Memberships or Packs are those in effect on the day the Membership is subscribed to or the Credits or Pack are purchased. Payment can be made by the Member, by cheque, bank transfer, or direct debit.

In the case of payment by direct debit, the Subscriber must provide Sanctuary with their bank account details, a photocopy of their identity card, and sign the SEPA direct debit mandate. Payments will be split into weekly debits from the Member's account. The Member agrees to inform Sanctuary of any change in bank details as soon as possible. In the event of a payment incident, the direct debit amount must be paid directly to Sanctuary by another payment method, plus bank charges. In the event of repeated payment incidents, Sanctuary reserves the right to terminate the contract at the Member's sole fault, and to demand payment of the outstanding sums.

In the case of payment by cheque, the Session is payable in advance. Proof of identity will be required.

In the event that the Subscriber fails to meet his payment obligations, the sums normally due may be debited directly from his bank account.

Article 6 – Internal regulations

Within the Studios,Members must not be harassed by violent behaviour or behaviour likely to offend decency, good morals, the peace of Members, or the proper order and cleanliness of the Studios.

The Member shall comply with these internal regulations, adhere to them without restriction or reservation, and observe the following instructions:

Not permitted in the Studios:

  • Minors, unaccompanied by an adult;
  • Any person making sexist, racist or religious remarks;
  • People who are sick, injured, with wounds, dressings, or skin infections;
  • Animals, even when kept on a lead; ;
  • People whose health condition does not allow them to participate in sports activities;
  • People with heart problems.
 

Inside the Studio, it is prohibited:

  • To stay outside opening hours;
  • To enter the Studio without a valid subscription, package, or credits, or to participate in a class without being registered for it;
  • To bring food, alcoholic beverages, or glass bottles into the Studio; ;
  • To annoy Members with violent or inappropriate behavior;
  • To run around the Studio;
  • To use transistors or any other sound emitting or amplifying device.
 

Security :

  • In the event of an incident or accident, Members are required to notify, in order of priority, the coach, the Studio reception, and the fire brigade or ambulance service immediately;
  • Members are required to comply with the instructions and directions given by the coach;
  • In the event of an individual whose behaviour presents a danger to Members, Studio staff or themselves, Sanctuary may involve the police.
 

Undressing, dressing and preserving clothing items:

  • Members must, under penalty of exclusion, undress and dress in the changing room provided, deposit their belongings in the lockers intended for this purpose, and leave the changing room in a perfect state of cleanliness;
  • Access to the changing room is restricted to people of the same sex only.;
  • Members are required to deposit their clothing in a locker.
 

Hygiene and behavior of Members

  • Each Member must be equipped with gloves and under-gloves (for Le Cercle Studios), clothing suitable for sports (for all Studios), footwear suitable for sports (for Le Cercle, Decibel and DRIP), and a swimming costume (for Aqua By). Sanctuary reserves the right to refuse access to the Session to any person not meeting these requirements. No refunds for Sessions will be given in such circumstances.
 

Aqua Studios Specific House Rules:

  • Each member must wear swimming trunks or a swimsuit exclusively for swimming and water activities. No other attire will be permitted.;
  • Before entering the pool, Members are required to take a soapy shower. Access to the pool will be refused to anyone not in an impeccable state of bodily cleanliness or not wearing decent attire.
 

Within the Aqua By Studio premises, the following are prohibited:

  • To enter the sauna or steam room without having participated in a session beforehand; ;
  • To enter the pool without authorisation from the coach; ;
  • To walk with shoes after the take-off zone (indicated by a sign) except with plastic shoes intended for this purpose;
  • Chewing gum in the pool;
  • To dive, jump into the pool or push a person into the water;
  • To do prolonged immersions, breath-holds, alone and without warning the coach;
  • To simulate drowning;
  • To use diving accessories, apart from swimming goggles; ;
  • To use electrical appliances near the pool;
  • To bathe with one's body coated in cream or oil;
  • Individuals who cannot swim must inform the coach and report this in writing to reception.
 

Miscellaneous :

  • It is strictly forbidden to damage the amenities and facilities. All damage will be repaired by Sanctuary at the offender's expense. Vandalism of any kind will result in legal proceedings.;
  • Any act or behaviour that is likely to offend decency, good morals, disturb the peace of the Members, or compromise the orderliness and cleanliness of the Studio is strictly forbidden. This may be sanctioned by immediate expulsion from the Studio.;
  • The client must place their bath towel in one of the designated bins after use.;
  • The client must place their boxing gloves in the designated bin after use (for Studio Le Cercle);
  • It is prohibited to open emergency exits, except in case of emergency.
 

Article 7 – Payment by bank card terms

The Member may pay for their purchases directly on the Sanctuary website or via the Sanctuary application. The order amount will only be debited upon validation. Payment by bank card is secured by an encryption system provided by STRIPE, therefore, Sanctuary cannot access the confidential bank card number of the customer. Only national bank cards will be accepted by the security system, as well as Visa and Mastercard.

Article 8 – Insurance

Sanctuary accepts no responsibility for loss or theft within its Studio. Sanctuary reminds members that it is not its responsibility to monitor the personal belongings of members who have not been stored in a locked locker.

Sanctuary is insured for damages for which it is liable. Its liability shall not be incurred in the event of an accident resulting from non-compliance with safety instructions or inappropriate use of equipment or other facilities.

The Member is invited to subscribe to supplementary insurance specifically covering risks associated with the sports activities provided at Studio Sanctuary.

In accordance with Article 38 of the law of 16 July 1984, Sanctuary informs the Member of their right to take out «personal accident» insurance which will cover all activities they are likely to practise within the Sanctuary Studio, it being understood that this cover is optional, and remains entirely the responsibility of the Member.

Article 9 – Irrevocability of membership and withdrawal period

The purchase of Credits, Packs, or Subscriptions implies full and unconditional acceptance of these General Terms and Conditions of Sale.

In the event of subscribing to a Subscription or acquiring Credits or a Pack online remotely, the Member shall benefit, in accordance with the provisions of Articles L121-19 et seq. of the French Consumer Code, from a period of fourteen (14) clear days to exercise their right of withdrawal, without having to give any reason or pay any penalties, with the exception, where applicable, of return costs.

The Member may waive this deadline if they are unable to travel and simultaneously require an immediate and necessary service for their living conditions. In this case, they would continue to exercise their right of withdrawal without having to provide a reason or pay any penalty. This right of withdrawal does not apply to legal entities who subscribe to Packages and/or Subscriptions. Packages and Subscriptions are personal and may not be transferred to third parties by the Member under any circumstances.

Article 10 – Dispute resolution

These General Terms and Conditions of Sale are governed by French law. Any dispute between the Member and Sanctuary relating to the existence, validity, interpretation, execution and fulfilment of this agreement shall be submitted to the jurisdiction of the competent courts, it being recalled that the Member may bring legal proceedings before any of the territorially competent courts in the place where they resided at the time of the conclusion of the contract or of the occurrence of the damaging event.

Article 11 – Information about the consumer ombudsman

All claims must first be addressed to Sanctuary Customer Services with a view to reaching an amicable settlement.

If the Member has not received a satisfactory response, the Member may refer the matter to the AME Consumer Mediation entity within one year from the date of the dispute. The contact details for the AME Consumer Mediation are as follows: mediateurfevad.fr

Article 12 – Other provisions

  1. 1. Full agreement

The entirety of the stipulations in the General Terms and Conditions of Sale constitute the complete agreement between Sanctuary and the Member with regard to its subject matter and replace and annul all prior statements, negotiations, commitments, oral or written communications, acceptances, understandings, conventions, and agreements between the parties.

  1. 2. Invalidity of a provision

If any provision of this agreement is found to be contrary to any applicable law or regulation, that provision shall be deemed to be severed, without affecting the validity of the other provisions of this agreement.

Article 13 – Termination and Force Majeure

Since Credits and Packs are time-limited, they cannot be cancelled. Sanctuary undertakes to do its best to comply with the obligations set out in its General Terms and Conditions of Sale.

In the event that it is unable to fulfil its obligations due to events beyond its control or over which it has no power, no liability can be sought from it.

In the event of the Studio closing for more than 2 months, due to events beyond its control or attributable to it, the Member may terminate the Membership contract concluded with Sanctuary by registered letter with acknowledgement of receipt. In this case, the termination will become effective within 15 (fifteen) days of sending this letter. Sanctuary shall then refund any Sessions paid for and not taken by the Member. 

Sanctuary also reserves the right to cancel Sessions due to a lack of staff or participants in a Session (fewer than 5 people). In the event of a Session cancellation, the Member may benefit from an extension of the validity period of their Subscription and/or their Package, by one week compared to the originally planned expiry date.

The terms and conditions for cancelling the Subscription are set out in Article 4.5 of these General Terms and Conditions of Sale.

Article 14 – Security and limitation of liability

Subscribing to a Membership and acquiring a Pack or a Membership implies that the Member declares themselves fit to take part in sports activities.

Sanctuary's liability remains limited to the safekeeping of clothing items only, to the exclusion of any other objects, and provided that the clothes have been properly stored in a duly locked locker.

Members are personally responsible for any accidents they may cause or commit.

Article 15 – Information, files and freedom

The data concerning the Member is intended for the management of the Member's Subscription/Package by Sanctuary. In accordance with the law in force, Sanctuary may send emails to the Member, unless they object. The Member retains access rights regarding the modification of their data.

Article 16 – Derivatives, loans and returns

16.1. Loans

At each session, Sanctuary offers you the option to borrow a pair of gloves (Le Cercle) or cycling shoes (Space Cycle). These gloves and shoes are the exclusive property of Sanctuary and must be returned to the designated bins at the end of the said session. The same applies to towels lent to the Member. Anyone found not to have returned these borrowed items may face legal proceedings.

16.2. Returns

Sanctuary guarantees a full refund for any item returned within seven (7) days, provided all items are returned in the same condition as when purchased. This means items must be undamaged, unsoiled, unwashed, unaltered or worn (other than to try on the item) and all labels must be intact. Glove liners will not be taken back or exchanged.

Article 17 – MISCELLANEOUS

17.1. Video surveillance

The studio is under 24/7 CCTV surveillance.

17.2. Maximum attendance

THE CIRCLE :

Montmartre Room: 29 people during a session. The maximum capacity allowed in the venue is 95 people.

The Beaubourg room: 57 people during a Session. The maximum authorised capacity in the establishment is 179 people.

The Bastille room: 40 people during a session. The maximum authorised attendance in the establishment is 84 people (including 40 in the basement and 44 on the ground floor).

POSES:

The Marais room: 25 people during a Session. The maximum authorised capacity in the establishment is 49 people.

The Good News Room: 71 people during a session. The maximum capacity allowed in the establishment is 199 people.

DECIBEL®:

27 people during a session. The maximum authorised attendance in the establishment is 179 people.

DRIP:

The Montmartre hall: 49 people during a session. The maximum capacity allowed in the establishment is 99 people.

SPACE:

The Good News Hall: 55 people during a Service. The maximum occupancy permitted in the establishment is 199 people.

The Bastille room: 48 people during a session. The maximum authorised capacity in the establishment is 129 people.

AQUA BY et Premier bain :

Réaumur room: 16 people in the pool.

The Charonne pool: 20 people in the pool.

Batille hall: 17 people in the pool.

Boulogne room: 28 people in the pool.

Access times: Access to Sanctuary Studios is subject to the schedules of the Sessions offered, available on each brand's website (www.aqua-by.com; www.lecercle-boxing.com; www.poses-studio.com; www.drip-hiit.com; www.decibel-danse.com; www.space-cycle.com).

The studios open their doors 15 minutes before the start of the first session of a block, and close their doors 20 minutes after the end of the last session of the said block.

The Member must arrive 10 minutes before the start of their Session. In case of lateness, access to the Studio and therefore to the reserved Session may be denied, and the Member will have their Session deducted or face financial penalties. Access to the Studios and their equipment is strictly forbidden to the public outside of these periods.

No consumers shall be permitted on the premises outside these hours, except under special authorisation.

Shareable subscription

We know that sports are more fun with your friends, so we allow you to invite a +1 to each of your sessions. (session deducted from your subscription)

The credit system

The more credits you buy at a time, the lower the individual cost.

85% sessions cost 12 credits.
The number of credits required per session varies between 10 and 16 credits depending on different criteria:

  • the type of session,
  • attendance,
  • the schedule.

With credits, you can benefit from lower fares at times with less traffic.

Postponable sessions

Sick? On vacation? Or is your week too busy preventing you from completing your weekly session(s)?

No stress about losing your sessions! Sessions are carryover up to 3 weeks after the date the session is credited.
Each session credited to your account is valid for 4 weeks in total.
